Decertification Procedure
As stated previously, decertification can result if it is learned that the Certified Ground Water Professional (CGWP) misrepresented his/her qualification for certification or the CGWP does not follow the first six (6) canons of practice for CGWP. Solely as a self-policing measure, and if the Association so elects, upon receipt of inquiry relating to consideration of or possible decertification of a CGVR, the chairperson of the Certification Committee may appoint a chairperson of an ad hoc committee to investigate the inquiry and to evaluate if decertification should be considered. The chairperson of the ad hoc committee shall appoint the other members of the ad hoc committee. At least one other member will be an office r of the Association of Ground Water Scientists and Engineers (AGWSE), and at least one (1) member of the AGWSE Certification Committee. Following review of the ad hoc committee, recommendations will be made to the chairperson of the Certification Committee, the AGWSE Board of Directors, the Secretary, and legal counsel as to whether decertification process should be further considered.The AGWSE Board of Directors, with advice from legal counsel (if they deem it appropriate), will decide if decertification investigation is to continue. If decertification investigation is to proceed, the CGVR concerned will be notified in a confidential personal letter from the AGWSE Board of Directors Chairperson advising the CGWP of the pending action, explaining the decertification procedures, and requesting the CGWPs statement. Hearings, reconsideration, or any other proceedings concerning decertification, recertification, or denial of certification shall be conducted at the will and sole discretion of the Association. No enforceable rights to certification, or to any due process or other procedural guarantees, exist nor are such intended to be created hereby, express or implied.
After notice to the CGWP, the AGWSE Board of Directors Chairperson shall direct legal counsel to prepare a document of decertification presenting the basis for decertification, the supporting information, and the direction to the Chairperson on the steps to be taken. The document of decertification may be provided to the CGWP being decertified, at the CGWPs request for the CGWPs use should the CGWP be interested. 'Me request by the CGWP for such information, and its release to the CGWP, shall constitute a waiver and release by the CGWP, or anyone claiming on his/her behalf, of any claims for defamation, invasion of privacy, or any other claim, of any nature, arising out of the publication or dissemination of such information.
